Enforcement of a Money Order
When proceeding with an Enforcement Hearing Summons, firstly you need to send the debtor a letter enclosing a Statement of Financial Position (SOFP) to complete and return.
This document provides information in regards to the debtors income and expenditure and any assets they may own which will help you determine which enforcement option to utilize.
If the debtor fails to complete and return the SOFP within 14 days, we can proceed with an Enforcement Hearing Summons, whereby the debtor is required to be served to appear in court to provide the information requested in the SOFP including documentation to support same.
With the information obtained in the SOPF, if the debtors employment information is known, the debtor is not self-employed and the debtor has sufficient surplus funds, an Enforcement Warrant – Redirection of Earnings is a great option to proceed with to recover the debt.
Once the documents are sent to Court, the registrar will assess the SOFP and specify an amount to be deducted from the debtor’s earnings under the order.
The filed documents are required to be served upon the debtor’s employer and they are required to comply with the orders made.

Alternatively, if the debtor has indicated that they own property that is not encumbered i.e. a boat, an Enforcement Warrant – Seizure and Sale of Property is also another option for recovering the debt.
The Bailiff will tag the property and give notice to the debtor and if the debtor fails to pay the balance, the property will be seized and sold at auction and the funds will be forwarded in payment of the debt, whether it be partially or wholly.
